Lots are conveyed by Burial Rights to the purchaser, his family and heirs.  Persons desiring to purchase a cemetery Burial Right should visit the cemetery office for assistance in selection of lots. 
 

A Burial Right document is issued after a lot is fully paid for.  This Burial Right is recorded with the Williams County Recorder.

  

No lot may be subdivided or transferred except with permission of the Sexton and recording same with the City Auditor.

  

The Sexton or authorized personnel may repurchase lots and Burial Rights in the name of the City.

  

 

 

Monuments & Markers - Memorials

 

Monuments are permitted in Riverview Cemetery, except in Block 11, and other locations as specified by policy.

  

Monuments are not permitted in Hillside Memory Gardens.

  

Any stone above ground level is classified as a monument, which cannot exceed 42" in height.

  

The size of the monument is based upon lot size.  The length of the base shall not exceed 75% of the width of the lot.

  

No monument or marker shall be placed at a grave site until the lot is fully paid and the Burial Right issued and recorded.

 
 

Interments & Funerals

 

Interment orders must be given 24 hours in advance for burials from April 15 to October 15, and 48 hours in advance from October 15 to April 15 for winter burials.

  

Burial Requests forms must be completed before interment in Williston cemeteries.

 

To lessen the possibility of error, lot owners or other authorized personnel may be required to call at the cemetery personally.  Arrangements for burials ordered by telephone will be accepted only at the option of the Sexton or cemetery personnel.

 

Permission in writing from a lot owner or authorized person is required if the order for an interment is for a deceased person not of the immediate family of the lot owner.

  

All rough boxes used shall be of concrete or steel vaults.

  

Funeral activities while within the cemetery grounds will be under the control of the Sexton or cemetery personnel.

 

 

 

Planting

No trees, shrubs or plants shall be planted in the cemeteries, except by permission of and under the direction of the Sexton or authorized personnel.

Decorations

 

All decorations placed on grave sites that interfere with mowing or other maintenance duties will be removed.  The exception to this rule is that decorations will be allowed on the grave sites 5 days preceding and 5 days following the last Monday of May.  This is for the observance of Memorial Day.

 

 

 

Burial Services

 

Burials are not allowed on Sundays and legal holidays as set by North Dakota Century Code.

 

 

 

Fees

 

The price of lots (Burial Rights), interment charges, opening and closing graves and disinterments are set by resolution of the Board of City Commissioners for the City of Williston.

 

 

Payment

All charges for lots, services and devices are payable to the City of Williston in advance or within 30 days from the date of purchase or ordering of work done, or use of devices.

Advisory Board

 

A 3 member advisory board meets 6 times a year with meetings at 3:00 pm at City Hall on the 2nd Wednesday in January, March, April, May, July and September.  The public is always invited to these meetings to discuss cemetery issues.

 

 

 

Perpetual Care

 

There is a Perpetual Care Fund administered by the City Auditor of the City of Williston.

  

The principal of the fund remains in trust with the interest on the principal utilized as operating funds for the care and maintenance of the cemeteries or added to the principal for the fund.

 

All non-tax funds currently held by the City, which have been designated for Perpetual Care are merged and administered as part of this Perpetual Care Fund.

  

The City of Williston is authorized to accept donations from any and all sources for the fund.

 

10% of the proceeds of Burial Rights sales as set forth by resolution of the Board of City Commissioners shall be allocated to the principal of the fund and be subject to the restrictions on use set forth.

 

Rules & Regulations

 

A complete list of rules and regulations per ordinance are filed with area monument dealers or available from the cemetery office.  They have been designed to protect the cemetery and the personal property of lot owners.

 
 


 

Williston Cemeteries are operated under and according to North Dakota State laws and the Williston City Ordinance No. 844.
